Probate Strategy (That no other probate attorney will tell you!)
Probate is the way your estate gets distributed to your spouse, children, grandchildren, siblings and other relatives, or other people or places you have chosen. What is your estate? Do you have a home, a car, furniture and appliances, jewelry, a savings account? Everything you own is part of your estate. After you die, it all has to go somewhere. Hopefully, you have done some estate planning in advance, where you created wills and trusts to decide who gets all your stuff. Depending on how you did your estate plan, some, most or all of your property might have to go through probate before it gets to your heirs. A will, for instance, has to go through probate so a court can decide that the will is real and valid. The executor of the estate has to notify creditors, so they have an opportunity to present claims for payment before the heirs get their shares. These claims have to be paid or, if disputed, litigated. The heirs themselves can also sue if they think the will is invalid or is the product of some other person’s undue influence on the testator (a fancy legal word for the person making the will).

If you are keeping the house, I can walk you through the process to transfer the title. If selling it, I can guide you through the tedious procedure of clearing out the house, readying it for sale, and handling the proceeds correctly. One more thing: If the homeowner had a reverse mortgage on the house, call me immediately. The lender is likely moving quickly to foreclose on the property, so we have to move even faster to stop it.
